How did I get a visa and become an entrepreneur in the US?
I’m getting lots of questions about how I became an entrepreneur in the US. So here I explain what we did in my case and another option I’ve seen a Danish entrepreneur use. These are my experiences and my understanding of the situation in June 2010. I don’t know all the rules, and they change, so you need to have the details checked by a lawyer who specialises in the area.
My path to becoming an entrepreneur in the US
I came over because SPAMfighter opened an office in the US. We had the Danish company and opened an associated US company. I’m not entirely sure whether the precise structure was called a subsidiary or something else.
As I remember it at this point, you could apply to be posted there once the company had been there for a year. That’s the route I took myself. But it required lots of paperwork and checks.
I mention around 30,000 to 40,000 kroner in legal fees as something you should expect in that process. Beyond that, it depends on how many companies and other circumstances you’re involved in. In my own case, I talk about around 100,000 kroner in accountancy work, but I also had lots of different corporate arrangements and other things that made the case more extensive.
So that’s my situation and the amounts I mention back then. It isn’t a fixed price tag for coming to the US. I tell my own story as an entrepreneur in Iværksætter til jeg dør.
A US company can be another route
For an entrepreneur involved in fewer different things, or wanting to build their business directly in the US, another option may be to open their own US company.
I use Thomas Rosenstand as an example. He’d moved over with his wife. As I tell it, they’d closed most of their business activities in Denmark, kept some and opened a US company.
My understanding was that, among other things, you needed a clean criminal record and a business plan showing a substantial investment in the US business. But what counted as a substantial investment also had to be considered in relation to the business you wanted to run.
Thomas worked in search engine optimisation. As far as I remember, in his case the investment included two laptops, an office rented for a year and a leased car. You don’t need lots of machinery and equipment to work in search engine optimisation.
The business needs to get going
I’d been given a visa for three years myself. I didn’t know exactly how many years Thomas had received, so I won’t pretend to know.
My understanding was also that, during that period, you needed to show the business could generate revenue. It wasn’t enough simply to wander around over here enjoying life. I understood that the Americans wanted money and activity coming into the country.
If you had a business that could open in the US and start invoicing from here, for example, it could help bring income from Denmark to the US. I didn’t think it necessarily required insanely large sums.
Have someone review your specific situation
In the video, I say I’d found that things had become easier for Danes over roughly the previous year and a half. In my own interpretation, I connected that to Denmark’s role as an ally in the war against al-Qaeda and remarked that we’d gained something from the cooperation, even though Danish soldiers had paid a terrible price. That was my interpretation, not something I could explain in legal terms.
My practical advice back then was to find a lawyer specialising in helping Danes move to the US. Have a good conversation about how it can be done in your particular situation.
I mention three to six months as a timeframe to expect if the case went through. There were lots of papers and a lot of hassle. But my point was that it was possible. I’d been posted there, and I’d also seen another Danish entrepreneur come over by opening a business. If you wanted to try, I didn’t think you should give up in advance.
Lots of people ask how I got a visa and can be an entrepreneur in the US. I explain it here: Best wishes, Martin
Hej Thomas,
Tusind tak for en fed video. Jeg har længe gået og overvejet en længere tur til Californien, og afklarer dine erfaringer utrolig mange ting for mig.
Super at det er så simpelt, som du beskriver det.
Go’ weekend!
